New report highlights delays in releasing children from custody

His Majesty’s Inspectorate of Constabulary in Scotland (HMICS) and Healthcare Improvement Scotland (HIS) have called on Police Scotland to act quickly to improve safety and care in police custody.

A review of 10 custody inspections carried out over the past three years found some improvements, including better oversight of children in custody and a reduction in the number of children being held. However, concerns remain about how vulnerable detainees, including children and people at high risk, are managed. Inspectors found inconsistencies in risk assessments, cell observations and the recording of important information. They also identified cases where children and adults were kept in custody for long periods after decisions had been made to release them, with delays sometimes linked to care providers collecting children.

The review also highlighted staffing pressures, ageing custody facilities, limited management oversight and outdated IT systems. Staff reported that the current staffing model is unsafe and difficult to sustain, with some areas experiencing critical weekend capacity and detainees being moved long distances between custody centres. Healthcare services have also improved in some areas, particularly around medicines and infection control. However, delays in accessing mental health support remain a major concern, alongside staffing and training issues.

HMICS and HIS have made three new recommendations, including a call for Police Scotland to urgently review its custody operating model. They will continue to monitor progress towards providing safe, consistent and rights-based custody services.
