New report highlights key priorities for human rights incorporation in Scotland

A new expert briefing commissioned by Human Rights Consortium Scotland (HRCS) outlines key priorities ahead of the planned incorporation of international human rights treaties into Scots law and the 2026 Scottish Parliament elections.  

The report, written by Professor Nicole Busby, assesses the Scottish Government’s proposed Human Rights Bill and identifies six focus areas for civil society engagement.

  • Keep compliance-based incorporation at the core, ensuring Scotland fully embeds international human rights standards into domestic law. 

  • Clarify how incorporation interacts with devolution. 

  • Strengthen recognition of environmental rights.  

  • Simplify and streamline positive duties.  

  • Examine equality and discrimination treaties in more depth. 

  • Safeguard public services from privatisation risks. 

HRCS says the briefing should inform advocacy and action in the coming months as Scotland prepares for major human rights law reform.
