Scottish Parliament is holding a consultation for a proposed Member’s Bill to ensure restraint and seclusion of children and young people in schools is only used as a last resort where there is an immediate risk of harm and using appropriate methods.
In the UK child rights review, the UN Committee on the Rights of the Child made specific recommendations on the use of restraint and seclusion in school settings. The Committee recommended that the UK and devolved governments should:
“Explicitly prohibit the use of restraint and seclusion in educational settings and adopt a child rights-based approach to addressing violence or other disturbances in schools, including by prohibiting the presence of police in schools and providing regular training for teachers on relevant guidance for addressing such disturbances in a child-sensitive manner;” and “end practices, including academic selection and testing measures, that contribute to the high levels of stress felt by students owing to academic pressure and ensure that children benefit from a creative learning environment.”
