xTogether responds to Children in Performances consultation

Together has responded to the Scottish Government consultation on proposals to update the arrangements in place for children involved in performances in Scotland.
The consultation called for views on proposals to update and improve the existing arrangements for ensuring the wellbeing of children under school leaving age who are involved in performances.
In its response, Together welcomed the Scottish Government's recognition that the UN Convention on the Rights of the Child (UNCRC) sets out the guarantees that every child must have in Scotland, and that wellbeing describes the outcomes that children are likely to experience as a result of the guarantees within the UNCRC being delivered.
The process of updating the current arrangements for children involved in performances with the aim of 'Getting it Right for Young Performers' is an opportunity for the Scottish Government to further its commitment to 'make rights real' across Scotland. It is also an opportunity to progress the commitments made to children's rights within Part 1 of the Children and Young People (Scotland) Act 2014.
The consultation response calls for a Child Rights Impact Assessment (CRIA) to be carried out on the proposals. It highlights the health and developmental benefits of realising Article 31 of the UN Convention on the Rights of the Child (UNCRC) on the right to participate in recreational, cultural and leisure activities, and recognises Article 32 and the importance of protecting children from performing any work that is likely to be hazardous or to interfere with the child's education, health or physical, mental, spiritual, moral or social development. The response employs the general principles of the UNCRC (particularly Article 3 and 12) as a framework, indicating that legislative change and production of guidance must respect, protect and fulfil such principles.
